An arbitration cannot exist without the arbitrator: he is the arbiter of the parties’ dispute and obliged to reach a final decision on the matters put before him; he is the master of procedure, tasked with ensuring that the arbitral proceedings are conducted in a fair, objective and efficient manner. The selection of the arbitrator is therefore a critical step in the arbitration process and who you select could well make or break the case. 


However, the procedure for nomination can vary from one case to another depending on parties’ agreement, whether the proceedings are ad-hoc or which institution is administering the arbitration. Issues can also arise during the appointment process, such as when there is a non-participating respondent, where there are multiple parties in the arbitration (e.g. can a joint nomination be reached?) or parallel proceedings (e.g. should a party appoint the same co-arbitrator in related matters), and whether it is desirable to obtain party input before co-arbitrators put forward a candidate for the role of presiding arbitrator. Apart from the above procedural considerations, other factors that can influence arbitrator choice include that arbitrator’s counsel commitments, intra-tribunal dynamics, arbitrators’ qualifications and subject-matter expertise, and diversity within tribunals. 


With so many considerations to balance and so much at stake, is there a risk that in seeking an “ideal” or “perfect” arbitrator, we have overcomplicated the selection of arbitrators and lost sight of the users’ primary goals? 


An experienced panel of speakers from the ICC Institute of World Business Law and the ICC Court will take a deep dive into the various current issues related to the selection of arbitrators, and offer participants practical tips on how to choose the right arbitrator for each dispute. 
 
This will be the first ICC Institute Chapter Connect to be held in Tokyo, Japan. It will take place on 18 November 2024 at 4:30pm at the Tokyo offices of Nishimura & Asahi (Otemon Tower, 1-1-2 Otemachi, Chiyoda-ku, Tokyo 100-8124, Japan; registration starts at 4:00 pm). Attendees who are unable to join the in-person event in Tokyo are welcome to participate remotely. The session will be over 90 minutes, not including the time for informal discussions and networking.
